What is an Estate Plan?

During your life, you will accumulate assets and debt, it is important to know who will inherit your assets and debts upon your death as well as who can legally assist you if you lose mental capacity during your life.  A comprehensive estate plan is generally comprised of a revocable living trust, a pour-over will, a general durable power of attorney, and an advance healthcare directive.  It will be my pleasure to educate you on how each of these legal documents work so that you can be empowered to create a plan that works best for you.

What is a Trust?

Setting up a trust is a popular estate planning tool, especially if you want to leave properties and assets to your loved ones without the hassle of undergoing the probate process. In a trust, the creator or trustor transfers his property under the care of a Trustee.  During your life, you are the trustee of your estate and your trust can be revocable.  At your death, your trust becomes irrevocable and your successor trustee has the responsibility to ensure that your beneficiaries receive their inheritance.

What is a Will?

A will is a legal document that will clarify how your assets shall be distributed at  your death as well as name the guardians of underage minors.  Assets listed in your will or that do not have an operation of law to get to your heirs, such as a beneficiary designations or payment  on death accounts, will need to be probated.
